One of the issues that new technology raises is the legality of delivery and use of documents in a real estate transaction via electronic means. Federal and Wisconsin state E-Commerce laws have been created to deal with the use of electronic documents in real estate and other transactions. The rules, however, set up specific requirements and REALTORS® need to understand which documents can be used, and how to gain valid consent. The consent requirement is only necessary when a consumer is using and receiving electronic documents in place of documents required by law to be in writing. The Wisconsin REALTORS® Association has developed forms that can be sent in advance of other future communication to consumers that desire to use electronic forms in place of written forms. By either providing the form electronically, or having a web site where the consumer can "click through" their approval, consumers and real estate professionals can enjoy the benefits of the convenience provided by technology. Keep in mind that the consent to use electronic forms must be received electronically, and a written consent is not sufficient.
